COLUMBIA, S.C. (AP) — A man has been charged with felony driving under the influence after a 3-year-old boy died from injuries in a wreck in Richland County late last week.

Charges against 44-year-old Lonnie Gross III were upgraded to felony DUI resulting in death Tuesday after Josiah Caden Jenkins of Columbia died at Palmetto Health Richland hospital.

The boy was in a car driven by his mother Friday evening when his car was struck by another car. She was treated and released from the hospital.

Gross also is charged with driving under suspension and failure to wear a seat belt.

It was not clear if Gross has an attorney.

A background check by the State Law Enforcement Division shows Gross had a DUI conviction in Lexington County in 1993, another in Kershaw County in 1999, one in Elgin in 2000 and another in Kershaw County in 2007.

Gross was out of jail on bond awaiting trial in a November DUI arrest at the time of Friday’s accident, SLED records show.
