Woman gets year for fatal hit, run 9/23/2009 8:12 PM

An Aiken County woman who was involved in a fatal wreck, fled the scene and lied to police in an attempt to cover up her crime was sentenced Wednesday to one year in jail.
Ginger Carpenter of Warrenville was set for trial this week on charges of leaving the scene of an accident involving a death. Instead of facing up to a possible 25 years in jail at trial, she pleaded guilty and was given the minimum sentence.
Flanked in court by her attorney and about a dozen friends and church members, Carpenter spoke in barely audible tones to Judge Markley Dennis Jr.
The solicitor's office had negotiated a sentence of between one and five years for the crime, Dennis, swayed by the church support behind Carpenter, said "for everything I have heard, this case merits the minimum sentence."
This is a no parole offense, so the defendant must complete more than 10 months before she is eligible for parole.
On May 22, 2008, at about 1 a.m., two collisions happened on Storm Branch Road in Aiken County. Two motorcycles had a minor accident. Then, shortly afterward, Carpenter's 1997 Ford Exhibition hit James Alan Cohrs of Rita Court in North Augusta, killing him.
According to testimony, the victim's blood was later discovered on the offending vehicle, and his heart and other organs were found outside of his body.
At the time, law enforcement said it appeared as if Carpenter's vehicle struck a Harley Davidson driven by Michael Younts, 48, of Coventry Court in North Augusta and then drove 100 yards and struck the Harley Davidson that Cohrs was driving.
Part of Carpenter's car were left behind from the impact, and her vehicle type was identified.
The next day, after a plea from law enforcement, someone called police with information that Carpenter's vehicle had been damaged. She was arrested later that day.
If the case had come to trial, it was said in court it would have come down to a "battle of the experts," according to Carpenter's attorney.
The Warrenville woman does not accept responsibility for killing Cohrs, and referred to the event as "a very tragic accident," but did admit that she broke the law.
Since the accident, Carpenter has begun volunteering at a home for the elderly and has attended meetings where DUI victims express the impact that crime has had on their lives.

Our justice system has no justice in it. One year (more like 10 months) for killing someone, un freeking believable. She should at least spend the rest of her life rotting in jail.

How do you get one year on a felony no parole charge of leaving the scene of an accident with a fatality. That charge is reserved for the one who caused the accident and left the scene of the accident and fatality failing to report it. Hitting the result of someone else's accident leaves you a witness failing to report and that is not a felony crime. Can you please show me the law that leaves Ginger a felon for for being a witness of road debris which was the bike already down?

This is not much different from the time Skipper Perry ran home after wrapping his bumper around a telephone pole and then when the cops came to his door he was holding a glass of booze so how could they say he was drinking when the accident happened. Typically, when people drink and drive, and an accident happens (small or big as in this case) they just keeping driving home. Happens every day on the streets of Aiken County day and night - it's the nature of the DUI driver.

She was afraid of a deer? She claims to hit what she thought was a deer and then drives to the safest place she knew, her home? So you're saying she was afraid of the deer? That it was going to somehow, get up and come after her and gouge her with its antlers? Or was it that she was afraid it would call 911 and she would get arrested for DUI? Give me a break! Storm Branch Road isn't so scary, I live a 1/4 mile from it, but most roads are dangerous when you're driving them sober, not to mention how dangerous they become when you are drunk. Stay off the friggin roads boozers! Call a cab..get a designated driver..or better yet, stay at home with your children! Maybe then we won't have tragedies like this one. Ginger at least gets to come home and see her family after a year. The friends and family of Mr Cohrs will never get that chance again.

The girls know who we are and where to find us. Two of us were with her on Friday so that should narrow us down. The person in the white pickup truck knows something; they know who they are. If they have no concience, then they will get what's coming to them in the end. Ginger admits guilt in leaving the scene, not causing the death. Don't pass judgement unless you know the truth or the person. How many times have any of you been down this road at night where the accident happened? I have..It is avery dangerous road in the daytime and it is a very dark scary road at night. As a woman, I would not stop on this road at night if I didn't have to. Ginger knew that she hit something..she thought it was a deer; which has happened to many people traveling that road. She went to the safest place that she knew and that was her home. You people do not know how this accident has impacted her life and the lives of others involved. It could happen to any of us at any given time. Stop and think of how you would feel if you were in her shoes, being accused of something that you know you did not do. There was evidence of another vehicle before hers...why are the investigators not looking for that vehicle?? Why do they assume that she was the one who hit him??? Where is the other vehicle that the parts that were found at the scene? There are too many discrepancies in the whole story, so focus your blame on the person who did it, not on Ginger. She had many friends who were bikers and she loved her biker-friends. She would never intentionally hurt anybody, let alone her biker-friends. She would like to know who this mystery vehicle belongs to, also, because they have made her life a living hell for the last year!! Now she will have to be away from her children, husband. family and friends for a year and endure prison life(which isn't very pleasant) because of this person.

As a mother, it makes me feel sick and worried that this piece of trash will be out of jail in less than a year and back on the roads. What kind of message does this send to kids? That its ok to run someone down, leave them to die on the road and go home like nothing even happened? One year is not by any means long enough for the crime this woman committed. The police and media put our inaccurate information which everyone believes as fact. Fact Jim and Mike collided. Ginger did not hit them both. Fact a witness stated to police he saw the riders go down (it's on tape) fact He stated he saw a vehicle go over something like a speed bump. He spoke to this driver and they said they would call 911. He stated he thought this was a white puckup truck. Part of a truck was found at the scene. This witness and the truck then left the scene. Ginger drove a dark green expedition. Don't let facts get in the way of a good gossip. I am in contact with a friend of Jim's. I am sharing the information i have. Ginger didn't kill Mr Jim Cohrs.She did not run him over. She did hit his bike. She honestly didn't know it was a bike (believe it or not it's true). Spike, I know who you are. I have been to Hoze's. Could you start by calmly admitting you don't know all the facts.If you allow your anger to prevent you from accepting the facts you cannot learn the truth.I'm attempting to share what we know so the truth comes out.Ginger left because she didn't know. The witness (you know who he is) did know and left Jim alone unprotected lying in a street in the dark of night.If you go for help you usually return with help. She only got one year because she plead guilty and the justice system negotiated an absurd sentence. You also indicated that she had evidence to prove herself innocent in court? THEN WHY DID SHE PLEAD GUILTY? Why not go to court if the evidence is so heavy in her favor? You also reference another vehicle, if that were true then why did Ginger leave the scene? Why not stay and share that information with the police to assist them in finding that vehicle? A vehicle she claims is responsible for murdering a man. Is she that cold hearted - to leave a man dying on the road and to let his potential killer get away because she was scared of a "biker gang" that just minutes earlier she was sharing a beer with? This was not a man she didn't know lying there dying. She may not have known him well but she knew who he was. As far as the position of the bikes, that is really irrelevent. What is relevent is that she was operating the vehicle that was behind the bikes and that hit the bikers. That is proven by the parts of her car left behind at the scene and by Jim's blood on her vehicle. Why no parts from the other vehicle involved or was it simply debree that was found left on the road from the numerous cars that travel that road daily yet attorneys have convinced you both that another vehicle was involved that night in this murder? A good attempt by an attorney trying to provide an alternate ending to a murder. You also indicated that you would speak to Jim's family and friends. Lets just see if you really are? I am the owner of Hoze's located at 793 Belvedere Clearwater Road 803-593-6633 (just ask Ginger - she knows where it is) the private club that Jim and his friends the "biker gang" as they have been called were delivery flyers for an autism event we were hosting the night he was murdered. I am there every Tuesday between 5pm and 9pm doing the paperwork feel free to come by and meet Jim's "biker family and friends" and share with us the "truth" that will make clear the details of this accident. A truth that Ginger was not willing to pursue in court to prove her innocence. Hmmmmm....... And lastly I ask of both of you where is the REMORSE. Regardless of the details a very special man is dead and due solely or in part (depending on your view) by Ginger's actions. I have yet to hear Ginger take any responsibility or say she is sorry.

To see this injustice, wow, how truly sad. The men were doing positive things in life. They were not drunk and running around bar hopping. He lost his life in a cruel, hateful, traumatic manner and the system gave her a year. So she can get out, go back to bar hopping, drinking, driving under the influence of whatever substance she was DUI on, and not care about anything, especially RESPECT? No license suspended for 4 years? No probation for 5 years? No mandatory counseling, community service working with and helping the biker community with their endless charitible events? HELLO? One year is NO justice for what she did. This was not an accident. It was willful, intentional, neglect and abandonment. Jim Cohrs was one of the kindest, most caring people I have ever had the honor of having as a friend. He would go out of his way to help anyone, and give you the shirt off his back. Yes he was a biker, but it has nothing to do with the price of tea in China... They wanna say she ran cause she was scared?? BULLS**t!! She ran cause she was a drunk bar whore, following a bunch of guys to another bar while her husband was away and her poor children where at home. This breaks my heart to see the injustice served here. What about Jim's life, and what he was and ment to SO MANY people. My daughter will know never have the chance to meet her uncle, because of this drunk, lying, coward. I refuse to get over the outrageous sentence. The system is broken. In most other states, she would have gotten a 13 year sentence with eligibility for parole after 5 years. Not sure why the husband is upset with the Aiken Standard. This woman hit one motorcycles, kept driving 100 yards, hit another motorcycle, killing the driver of the second motorcycle she hit. What was she thinking, to continue driving after hitting the first vehicle? She was probably drunk out of her mind. She'll have a hard time living with that and I hope that she never takes a sip of alcohol again because you see what that leads to. I'm still shocked she got a slap on the wrist but it doesn't shock me after living here for awhile.

Normally..innocent people don't leave the scene of a crime.. And if she was innocent, why did she plead guilty to it?? If I was innocent of a crime, I would NOT plead guilty to it regardless of the evidence. There are always THREE sides to every story, your side, their side, and the TRUTH. And one of those truths is that a man was hit and killed and evidently your wife's vehicle was damaged and had his blood on it?? How do you explain that? To be honest, I do think that there is a lot more to this story, BUT I also believe that your wife isn't as innocent as she claims to be either. Another truth...she left the scene. She was going to prove in court that she had nothing to do with Mr Cohrs death?? If that was the case then why didn't she plead not guilty and prove it? Instead she plead guilty! I don't claim to really know any of the facts but to me she proved her responsibility when she left the scene of an accident. That admits guilt in my book!

There IS always more to the story, but from what I heard it isn't as deceptive as these posts make it sound. No one was hiding anyhting except Ginger adn the bikers who refused to come forward. From what I heard she would have most likely lost at trial despite her "evidence". It is a great injustice that the judge gave her one yaer when he could have given her up to 5 according to the negotiation. There was no conspiracy here simply a bad sentence given for to a guilty person for the wrong reasons.

A terrible accident is horrible road conditions, your vehicle suddenly blowing a tire and swerving hitting another etc, a tree falling in your path causing a fast movement...accidents. This wasn't an accident, you don't accidentally drink then accidentally grab your keys and start your engine, you don't accidentally drive your vehicle after drinking and you sure as hell don't accidentally leave the man you know you just killed behind because you accidentally worry about the law. This was murder. She left that man on the road and drove home, if she had nothing to do with his murder why not stay there with the man till the ambulance came?

I do not agree with the sentencing that Ms. Carpenter got. She was out drinking with the "biker gang", as some have called them,and wilfully left the bar and was going to another bar. Her husband was out of town because of his job. She should not have been out DRINKING with anyone. She had school age children at home.She should have been home taking care of her daughters. Having lost a child to a drunk driver, I totally disagree with the sentence she got. Drinking or not she left the scene! Something tells me that if someone walks out of court with only one year to serve there is something that is not being told. If I had to guess I bet the Highway Patrol who investigated this has screwed something up. What about the guys who were also drunk and lied to the troopers about what happened. Did they screw up the evidence making it impossible to bring it to court? Why were they not involved in the sentence? This lady was wrong and cases like this dont get handled like this unless something was brought out by a defense attorney showing someone screwed up and they were happy to get her a year. I think the Aiken Standard should get a copy of the report and see what is what. I think there something law enforcement is not telling . Where are their bosses and why would they agree to a sentence like this ?

Mrs Carpenter is my wife.I want to know what lie she told the police? She is the only one who didn't lie. Ask yourselves why did she only get a year for a 20 year crime? The media are sensationalizing this tragic case to sell papers. Some police officials spoke while not knowing the facts.The bad part is while my wife was crucified by the media the people who actually caused Mr Cohrs death were allowed to hide their part and go scott free.The truth is the state never could tell us what position the bike was in.They changed their theory several times to try to explain away the facts. My wife admited to hitting a vehicle that was involved in a previous accident. That she did. We proved Mr Cohrs position and bike position.I will not give the media a chance to lie again. That is the reason i will not speak to them. But i will gladly speak to anyone who wants to know the truth. I'm not hard to find. Also i would like to speak to Mr Cohrs friends and family personally now that i can,and share information we have with hopes of helping them find out the truth about this accident.

I blame both the court and the prosecuter in this case. Both had to agree on the sentence for it to stand. But then it is South Carolina expectations of justice are very low in that state from the Governors office on down. I live in SC and I see this type of BS on a constant basis.

Just months back Christine Bryant was sentenced in a hit and run in Beach Island.(aiken county) She hit an individual pedaling a bike on a dark road at night. She received 4 years. She was not accused nor supsected of DUI or anything else. Just simply scared and ran from the scene. This white lady who hits two motorcyclist of which Im sure had lights, killed one, was accussed of DUI and hit and run and she walks away with only 1 year. Who in the hell was that judge. Im sick of the justice system allowing things like this to occur. The bottom line is this sentence was impratical and unjust regardless of the ladies skin color. It's just wrong. Wake up Aiken. Just be glad it wasn't my family member she killed, or else Aiken would really have a story to talk about and it would have a different ending.

She is a mother who was out drinking and partying while her children were home in bed and her husband was out of town. She was not afraid of the "biker gang" when she was laughing it up with them, she was not afraid when she made arrangements to follow them to the next stop. She knew them and made plans earlier that evening to meet up with them. But suddenly becomes afraid when she slams her SUV into them , killing one of them and leaving the scene. As a victim of a hit and run this past May, thankfully I was not physically injured but my vehicle was significantly damaged. Luckily he got stuck on my vehicle long enough for me to get his plate number and although he fled the state, a warrant was issued and he turned himself in a month later... I am appalled that this idiot (among other names she could be called) got only a YEAR???? For killing someone?? All because she pled guilty and had a bunch of bible thumpers supporting her??? Give me a F***ING BREAK!!!! Where is the justice in that?? My heart goes out to the Cohrs family for not only this horrible tragedy but for the injustice of this crime. It wasn't a "tragic accident" it is a CRIME!! She HIT and KILLED an innocent person and FLED with the hopes of NOT getting caught!!! She didn't turn herself in, she was TURNED IN!! This makes me sick..a year?? What a deterrent..the punishments don't fit the crimes..no wonder the crime rates are so high..with only a slap on the wrists for those that commit them..In this case, makes me wonder what palms were greased on this one!
